1. Introduction

Welcome to StaticKit ("Service"), operated by Terradium ("we," "us," or "our"), operating as StaticKit. By accessing or using our Service at statickit.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Service Description

StaticKit is a managed static site blogging platform that combines the Hugo static site generator with a modern web-based writing experience. Our Service enables you to:

  • Create and manage static blog sites through a rich text editor
  • Publish content that is built using Hugo and deployed to Cloudflare R2 edge hosting
  • Connect custom domains to your published sites (Premium plan)
  • Manage your blog content through an intuitive dashboard

3. Subscription Plans

StaticKit offers two subscription tiers:

  • Free Plan: Includes 1 site, up to 100 posts, and standard StaticKit subdomain hosting. No credit card required.
  • Premium Plan ($9/month): Includes unlimited sites, unlimited posts, custom domain support, and priority features.

Premium subscriptions are billed monthly through our payment provider, Paddle. By subscribing to the Premium plan, you agree to Paddle's terms of service in addition to these Terms.

4. Account Registration

To use StaticKit, you must create an account using Google OAuth authentication. You are responsible for maintaining the security of your Google account and for all activities that occur under your StaticKit account. You must provide accurate and complete information during registration.

5. Acceptable Use

You agree not to use StaticKit to:

  • Publish content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringe on any intellectual property rights of others
  • Distribute malware, spam, or phishing content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service in any way that could damage, disable, or impair our infrastructure
  • Violate any applicable local, state, national, or international law or regulation

6. Intellectual Property

Your Content: You retain full ownership of all content you create, upload, and publish through StaticKit, including blog posts, images, and site configurations. We do not claim any intellectual property rights over your content.

Our Service: StaticKit, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our Service.

License to Host: By publishing content through StaticKit, you grant us a limited license to host, store, and serve your content as necessary to provide the Service.

7. Payment and Billing

Premium subscriptions are processed through Paddle, our merchant of record. Paddle handles all payment processing, invoicing, tax calculations, and compliance. By purchasing a Premium subscription:

  • You agree to pay the applicable subscription fees as described at the time of purchase
  • Subscriptions renew automatically each month unless cancelled
  • You may cancel your subscription at any time through your account dashboard; cancellation takes effect at the end of the current billing period
  • Price changes will be communicated in advance and take effect at the next billing cycle

8. Third-Party Services

StaticKit integrates with the following third-party services to provide its functionality:

  • Google OAuth: For user authentication and account creation
  • Paddle: For payment processing and subscription management
  • Cloudflare: For static site hosting (R2) and content delivery
  • Neon: For database hosting and management

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or policies of these third-party providers.

9. Service Availability

We strive to maintain high availability of our Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

10. Limitation of Liability

To the maximum extent permitted by law, StaticKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may terminate or suspend your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. You may terminate your account at any time by contacting us.

Upon termination, your right to use the Service will cease immediately. We will make reasonable efforts to allow you to export your content before deletion, unless termination is due to a violation of these Terms.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.
